Supreme Court allows CBI to question MP YS Avinash Reddy in murder case, stays restrictions imposed by Telangana High Court

The Supreme Court has taken an exception to the directions that were passed by the Telangana High Court which imposed restrictions on the Central Bureau of Investigation (CBI) while questioning Kadapa Member of Parliament (MP) YS Avinash Reddy in a murder case.

A Bench comprising of Chief Justice of India (CJI) DY Chandrachud and Justice PS Narasimha put a stay on the High Court’s directions that the questions put to him by the CBI be in printed form and circulated in advance, and that the interrogation be taped.

Senior Advocate Sidharth Luthra appeared for the petitioner. Senior Advocate Ranjit Kumar appeared for Avinash Reddy.

The apex court questioned on the kind of order given by the High Court and called it atrocious and unacceptable.

These directions were passed by the
High Court while hearing the anticipatory bail application of YS Avinash Reddy in connection with the probe into the YS Vivekananda Reddy murder case.

It is important to note that YS Avinash Reddy is cousin of Andhra Pradesh Chief Minister, YS Jagan Mohan Reddy.

Sunita Narredy, daughter of the deceased, challenged the High Court order before the Supreme Court.

In its order, the Apex court has sought the response of Avinash Reddy in the matter, and stayed further proceedings in the case before the High Court.

Protection from arrest was given to Avinash Reddy by the CBI till the next date of hearing, which is on Monday, April 24.

The petition in the top court had stated that the order under challenge had effectively derailed the probe, which as per the apex Supreme Court’s earlier orders, had to be completed by April 30 this year.

It was urged that the MP had never cooperated with the probe agency to be entitled to any protection,

Counsel for the CBI at today’s hearing pointed out that the bail applicant had coerced some officials into saying that he had a heart attack, to avoid interrogations.
