Gauhati High Court issues notice on PIL against schools

The Gauhati High Court has issued notice on a Public Interest Litigation (PIL) filed by petitioners aggrieved by non-implementation of Section 12(1)(c) of the Right of Children to Free and Compulsory Education Act, 2009.

It is stated by the High Court that previously in pursuance of the orders passed by the Court in other two PILs, the State Government has already issued requisite Notifications, mandating all unaided educational institutions to ensure strict compliance of the mandate of Section 12(1)(c) of the Act of 2009.

Yet, many institutions, impleaded as party respondents in the present petition, have refused to admit children in the current academic session, alleged the petitioners.

While considering the PIL, the Division Bench of Chief Justice Sandeep Mehta and Justice Parthivjyoti Saikia issued notice to the respondents.

The Court directed the R Majumdar, standing counsel, Education (Elementary) Department to instruct the Secretary to the Government of Assam, Education (Elementary) Department to look into the matter and ensure that the children, whose names have been provided in the Schedule are immediately provided admissions into the schools concerned.

Matter is listed on 08.05.2023 for further hearing.
