Supreme Court refuses to hear plea of SAD leader Bikram Majitha in drugs case

The Supreme Court today declined to entertain petition of Shiromani Akali Dal leader Bikram Majithia’s pertaining to quashing of FIR  against him under the Narcotic Drugs and Psychotropic Substances Act, 1985 by Punjab Police

The Bench led by DY Chandrachud was hearing the request where the judge asked the council of Majithia(Advocate Kapil Sibal)Why was a writ petition filed under Article 32 in this case? He further said that there are other remedies, and why are they not moving High Court.

The Apex top court told that Majithia can challenge the FIR before the Punjab and Haryana High Court and it can be heard by a Division Bench.

On March 28, the SAD leader moved to the Supreme Court with a desire of getting FIR registered by Punjab Police under NDPS Act

Former minister Majithia was given protection from his arrest till February 23 in view of assembly polls where he contested as an SAD candidate from Amritsar East assembly constituency. He had surrendered after the expiry of the period.

The Minister is currently in the jail of Patiala after his bail was rejected by the special court. He had contended of political motivation behind his arrest

After newly elected Chief Minister of Punjab Bhagwant Mann had on March 20 resumed the office, reconstituted the Special Investigation Team (SIT) investigating the drug case against Majithia.

The IGP-Crime Branch Gursharan Singh Sandhu is supervising a team  of four-members headed by an IPS officer, Rahul S,AIG Ranjit Singh and DSPs Raghbir Singh and Amanpreet Singh.

Last time  SIT was a three-member team headed by AIG Balraj Singh. The SIT was formed to probe allegations against Majithia based on an FIR lodged under various Sections of the NDPS Act on December 20, 2021.
