Supreme Court dismisses plea of Sushant Singh sister challenging Bombay HC order against her

The three-Judge Bench of Chief Justice S.A. Bobde, Justice A.S. Bopanna and Justice V. Ramasubramanian dismissed the plea, saying that it was not inclined to hear the matter.

ILNS: The Supreme Court on Friday dismissed a petition filed by late Bollywood actor Sushant Singh Rajput’s sister Priyanka Singh, challenging the Bombay High Court’s refusal to quash FIR filed against her by Mumbai Police on actor Rhea Chakraborty’s complaint.

The three-Judge Bench of Chief Justice S.A. Bobde, Justice A.S. Bopanna and Justice V. Ramasubramanian dismissed the plea, saying that it was not inclined to hear the matter.

The Bombay High Court had, on February 15, observed that there was a prima facie case found against Priyanka Singh, in an FIR lodged against her at the instance of Rhea Chakraborty, alleging criminal conspiracy and abetment to suicide.

The High Court, however, quashed the proceedings against another sister of Sushant, Meetu Singh, who was also named as an accused in the FIR. The Court said that the FIR against Priyanka Singh and Dr Tarun Kumar of Ram Manohar Lohia Hospital Delhi, on whose prescription the medicines were allegedly procured for Sushant will survive.

Senior Advocate Vikas Singh, appearing before the apex court, said that no illegal medicines were prescribed by the doctor to Sushant.

In her complaint on the basis of which the FIR was filed, Rhea Chakraborty had alleged that the sisters conspired with Dr Tarun Kumar to obtain a false prescription for administering banned medicines to the late actor.

Priyanka averred that the entire case of Rhea Chakraborty against her was “based on media reports” and thus, was devoid of credibility.

“The prescription was provided in accordance with the MCI Regulations and Telemedicine Practice Guidelines and Telepsychiatry Operational Guidelines, where it is permitted to medical practitioner to prescribe medicine through teleconsultation and also through caregiver,” read the appeal.

The sisters had claimed that the FIR was lodged to “concoct a whole new story entirely different from the statements” made by Rhea Chakraborty before the Supreme Court and media platforms. Both Meetu and Priyanka had sought an investigation into the malicious and malafide activities of the Mumbai Police and the Maharashtra government, for which they had sought damages under public law.

They had contended that Chakraborty’s FIR brought forth a different chain of events than what was being claimed by Rajput’s family and those circumstances should be examined as it could give answers to the cause of the actor’s death. Singh’s appeal was filed by Advocate on Record Nitin Saluja. Sushant was found dead in his home at Bandra, Mumbai on June 14, 2020.
