Are you law unto yourselves? Chief Justice of India asks Bar Council Of India

“Can you prescribe an exam without a rule? Are you a law unto yourselves?” rapped Chief Justice of India to Bar Council of India while hearing the matter on validity of All India Bar Examination.

The bench of Chief Justice of India T S Thakur and Justice U U Lalit also ordered the counsel to ask Manan Mishra, chairman, BCI to appear before the court.

The petitioner has challenged the resolution under which the BCI had introduced the All India Bar Examination in 2010. The AIBE was introduced on the basis of recommendations of the Supreme Court, constituting three-member for improvement in legal education.

The committee recommended amendment in the rules framed under Advocates Act, 1961. However, the BCI passed the notification in 2010 without the amendments.

The counsel for petitioner sought more time to clarify certain details.

The matter has been adjourned to March 2 as the exam is scheduled for March 6.
