Delhi HC defers hearing of Congress leader Bhavya Bishnoi’s plea for permission to travel to US for post-graduation

The Delhi High Court on Tuesday deferred hearing in a plea seeking permission to travel abroad for two years for post-graduation filed by Congress leader Bhavya Bishnoi, son of Kuldeep Bishnoi, MLA, Adampur, Haryana and Renuka Bishnoi, MLA, Hansi, Haryana accused under Black Money Act, 2015.

The single-judge bench of Justice Rekha Palli came to this conclusion after the counsel for Union of India, Vibhuti Malhotra, requested the court for a short date as they wanted to submit information in a sealed cover before the court, the court also directed the advocate for the petitioner, N.P. Sahni, to file rejoinder before the next day.

Sahni informed the court that the petitioner has been able to secure admission in a two-year course, Masters in Public Administration at the Harvard Kennedy School, John F. Kennedy School of Government, Cambridge, Massachusetts for which purpose he has to travel to United States of America on August 10, 2021 and is ready to return to India when his presence is required. Sahni further stated that in the case instituted against the petitioner is quoting properties from 1996-97 when the petitioner was aged three years old.

Vibhuti Malhotra informed the court that a complaint has been filed under Black Money Act, 2015 on July 30, 2021 and that the matter is listed at Magistrates Court on August 6, 2021. Malhotra also argued that if the petitioner is allowed to leave for two years, he can establish legal residency in the USA. The petitioner had previously travelled to USA from February 14, 2020 to March 1, 2020 and to Dubai on February 24, 2021 to February 27, 2021 after furnishing a Security of AG-059 (Old No.FLG04), Phase-I, Ansal Plaza, Greater Noida, UP and a surety of  five lakh rupees with the Registrar General of the Delhi High Court.

The petitioner had contested the Lok Sabha elections in 2019 from Hisar on a Congress ticket but lost to Brijendra Singh of the BJP. The bench has listed the matter for further hearing on August 4.
