Jaipur train shooting: Constable Chetan Singh additionally charged with hate speech

Maharashtra Police has additionally charged Railway Protection Force Constable Chetan Singh, who was arrested for shooting his senior and three Muslim passengers onboard the Jaipur Mumbai Super-Fast Express on August 1, with Section 153A of the Indian Penal Code (promoting hate).

The remand report prepared by the Borivali Railway Police mentioned the statements of eye witnesses to say that Singh had made provocative statements during the incident, which could create a feeling of discord, hatred, fear and insecurity between two religions. Therefore, Section 153A of IPC has been added to the crime, it added.

As per the report, Singh has additionally been charged with Sections 341, 342 and 363 of IPC related to wrongful confinement and kidnapping for allegedly dragging one of the victims from the boogie to the pantry area at gunpoint before murdering him.

The report submitted before the Borivali Magistrate Court on Monday said that Chetan allegedly had an argument with his senior and therefore shot him and three others.

It further said that Singh’s complete medical examination was underway at Cooper Hospital and that his custody was required to complete this medical evaluation. If insanity is proved, the 33-year-old may serve no punishment for his alleged crimes.

The report revealed that Singh’s voice samples and pictures have been sent to the forensic laboratory in Kalina along with the viral tapes to check whether the hateful words were uttered by him.

The Railway Police further sought custody of the RPF Constable to recreate the crime scene and collect further evidence. Borivali Magistrate Shivdatta Patil extended Singh’s police custody to August 11.

The Borivali Railway police had claimed that they could not obtain the CCTV footage from cameras of many coaches since the train was running every day.

Advocate Amit Mishra appeared for the accused.

On August 1, RPF constable Chetan Singh, travelling on Jaipur Mumbai Super-Fast Express train, allegedly tried to strangulate his colleague and fired four rounds on his immediate senior Railway Protection Force ASI Tikaram Meena.

He then moved to different bogies and murdered three passengers, later identified as Abdul Kadarbhai Mohammed Hussain Bhanpurwala (58), resident of Nalasopara in Palghar; Asgar Abbas Sheikh (48), resident of Madhubani in Bihar and Sayed Saifuddin alias Sayed Safiullah (43) from Hyderabad.
It was alleged that Singh uttered hateful words after killing the three men, allegedly on the basis of their religion.

He was booked under Sections 302 (murder), 151, 152, 153(A) (promoting hate), 342, 343 (wrongful restraint) and 363 (kidnapping) of IPC, along with Sections 3, 25 and 27 of the Arms Act.
