The bench, however, dismissed the petitions stating, “We are not inclined to interfere with the order.”

The petition has further raised the issue indicating that whether the High Court can entertain a PIL and direct the CBI to conduct a preliminary inquiry without it being shown that there was an abuse of power of investigation.

Maharashtra's government challenged the order of the High Court of CBI investigation against Anil Deshmukh in the Supreme Court. Anil Deshmukh also approached the Supreme Court.

On March 15, Vaze was sent to NIA custody for his alleged role in placing an explosives-laden vehicle outside the residence of Mukesh Ambani last month.

In the letter, Singh also said Deshmukh had asked arrested police officer Sachin Vaze to collect Rs 100 crore every month from bars and restaurants.

Contemplating whether Singh’s plea against Deshmukh is maintainable or not, the court said that it will address the matter on two aspects - is the PIL maintainable and can the court direct investigation without an FIR.

Apart from the inquiry, Singh sought the quashing of the order transferring him from the post of Mumbai Commissioner of Police alleging it to be arbitrary and illegal.

According to the plea, Deshmukh held meetings at his residence with several Mumbai police officials, including Waze, in February this year.
