Kerala High Court takes up case of agents of Saudi bank threatening Indian woman over alleged loan

New Delhi (ILNS): The Kerala High Court has taken cognizance on a case filed by a 44-year-old woman who had complained that agents of a Saudi bank had been threatening her for loans allegedly not repaid by her. The court directed the state police to take action against those agents of the foreign bank, according to reports reaching here. 

Justice Raja Vijayaraghavan V directed authorities concerned to take appropriate action as the complainant has been continuously receiving threat calls over a loan that she had taken and repaid from a foreign bank.

The woman had submitted before the court that she had availed a loan of 72,200 Saudi Riyals (around Rs 14 lakh) from Al Rajhi Bank’s Riyadh branch while she was working at a hospital in Riyadh. When her contract expired in May 2015, she returned to Kerala.

“Though she had effected repayment and had closed the loan prior to her return, one Sohail Ahammed contacted her over the phone on May 14 claiming to be an agent of the bank and told her that some money is due and a warrant has been issued against her,” the plea said.

She had also submitted that she had received many more threat calls regarding this matter. She had already filed a police complaint but no action was taken.

The counsel of petitioner has quoted a precedent that in a 2019 judgment (Suseela vs Director General of Police and others), the court had directed police to ensure that agents of foreign banks are not allowed to commit criminal acts offences, including threat and coercion, to effect recovery.

Going through all the facts, submissions and arguments, the bench, has held that in the 2019 judgment, it was held that any attempt to recover money from an Indian citizen can only be in accordance with the Indian laws.
