Supreme Court seeks response from West Bengal govt in plea seeking CBI probe into killing of two BJP workers

In this matter, the Supreme Court bench issued notice on Tuesday and the matter will be taken up for consideration next Tuesday.

ILNS: A writ petition, seeking CBI investigation into the killing of two BJP workers in West Bengal, has come before the Supreme Court vacation bench of Justices Vineet Saran and B.R. Gavai.

To this, the bench issued notice on Tuesday and the matter will be taken up for consideration next Tuesday.

The petition alleges that the killings have been committed by the members of Trinamool Congress on May 2, when the assembly election results were declared.

The petitioners are relatives of the two victims, one is the brother of Avijit Sarkar, 35 who was vice-president of a BJP-backed trade union and the other is the widow of Haran Adhikari, who was BJP booth worker. They have moved the top court for an independent probe by CBI or a court monitored Special Investigation Team (SIT).

Senior Advocate Mahesh Jethmalani appeared for the petitioners. He said: “This is a very serious case. There are two eye witnesses. The state is taking no action when two have been killed brutally. This is a matter which requires probe and transfer to CBI or a SIT.

“The activists who were murdered belonged to the BJP and it (the murder) was encouraged by the state administration,” Jethmalani submitted.

Jethamalani further made a prayer for video-recording of the post-mortem of the dead body of Avijit Sarkar, which has not been cremated so far. The bench said that it cannot consider this prayer ex-parte
