Demonetisation: Supreme Court adjourns hearing to November 24

The Supreme Court Constitution bench has agreed to the request by Central Government for adjourning the hearing of pleas challenging the demonetisation by the Central government in 2016 which devalued ₹500 and ₹1,000 bank notes.

Last month a Constitution Bench comprising of Justices S Abdul Nazeer, Justice BR Gavai, Justice AS Bopanna, Justice V Ramasubramanian and Justice BV Nagarathna had asked the government for filing additional replies.

The Court had also given todays date for presenting their arguments. 

The Attorney General (AG) R Venkataramani  who represented the centre has sought for a weeks time to file the response. 

The Senior Judge Justice Nagarathna in said that it is very embarrassing for the court as a Constitution Bench is never adjourned like this.

The Court has however accepted the request by the AG listed the case for further hearing on 24 November, it has clearly said that this time there should be no delay and that the matter should be closed by this year.

The AG was feeling embarrassed for seeking an adjournment but said he wants to be prepared well and in a structured manner for addressing any query.

The petitioner’s counsel Senior Advocate Shyam Divan,asked the requested the court for continuing the hearing despite the Centre’s inability to file a reply.

The Lawyer said the same thing as the Senior judge about the practice of this court where during a constitution bench an adjournment casnnot be sought

The Lawyer said that it would be his request that they be permitted to open and complete their submission such as they are and there is no problem.
